1. Acknowledgment and Acceptance of Risk
By using Gene Matrix LLC's genetic testing services, you acknowledge and accept the following risks and limitations:
Inherent Risks of Genetic Testing:
You understand and acknowledge that genetic testing involves inherent risks, including but not limited to:
- Psychological and emotional distress from learning genetic information
- Anxiety about potential health risks identified in results
- Impact on family relationships and dynamics
- Potential for discrimination (employment, insurance, social)
- Uncertainty and ambiguity in result interpretation
- Discovery of unexpected information (e.g., non-paternity, unknown relatives)
- False positive or false negative results
- Limitations in current scientific knowledge
Voluntary Participation:
You acknowledge that:
- Your participation in genetic testing is completely voluntary
- You have been given the opportunity to ask questions
- You have been advised to consult healthcare professionals
- You understand the limitations of the testing
- You accept responsibility for your decision to proceed
Informed Decision:
You confirm that:
- You have read and understood all provided information
- You have had adequate time to consider your decision
- You understand the potential benefits and risks
- You are proceeding with testing of your own free will
- No one has coerced or pressured you into testing
2. Release and Waiver of Liability
General Release:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, you hereby release, waive, discharge, and covenant not to sue Gene Matrix LLC, its officers, directors, employees, agents, contractors, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to:
Released Claims Include:
- Any loss, damage, or injury (including death) that may be sustained by you
- Any psychological, emotional, or mental distress
- Any adverse health outcomes or medical conditions
- Any decisions made based on genetic test results
- Any failure to detect genetic variants or conditions
- Any errors, inaccuracies, or delays in test results
- Any breach of confidentiality or data security (except gross negligence)
- Any discrimination or adverse treatment by third parties
- Any family conflicts or relationship issues arising from results
- Any financial losses or economic damages
Scope of Release:
This release applies to claims based on:
- Negligence (except gross negligence or willful misconduct)
- Breach of contract
- Breach of warranty
- Strict liability
- Any other legal theory
Exceptions:
This waiver does not release claims for:
- Gross negligence or willful misconduct by Gene Matrix
- Fraud or intentional misrepresentation
- Violations of law that cannot be waived
- Rights that cannot be waived under applicable consumer protection laws
3. Assumption of Risk
Voluntary Assumption of All Risks:
You expressly and voluntarily assume all risks associated with genetic testing, including but not limited to:
Medical and Health Risks:
- Risk that results may indicate increased disease susceptibility
- Risk of learning information about untreatable conditions
- Risk that results may be inconclusive or uncertain
- Risk that results may conflict with other medical information
- Risk of making medical decisions based on incomplete information
- Risk that genetic information may not predict actual health outcomes
Psychological and Emotional Risks:
- Anxiety, stress, or depression from learning genetic information
- Guilt about passing genetic variants to children
- Fear about future health prospects
- Emotional impact on family members
- Stress from uncertain or ambiguous results
- Psychological burden of genetic knowledge
Social and Familial Risks:
- Potential impact on family relationships
- Discovery of unexpected family information
- Conflicts with family members about sharing information
- Social stigma associated with genetic conditions
- Discrimination by others based on genetic information
Financial Risks:
- Cost of testing and follow-up care
- Potential impact on insurance (where not prohibited by law)
- Cost of additional medical testing or consultations
- Economic impact of health decisions based on results
Privacy and Confidentiality Risks:
- Risk of data breach despite security measures
- Risk of unauthorized access to genetic information
- Risk of re-identification of de-identified data
- Risk of genetic information being used in unforeseen ways
You acknowledge that you have been informed of these risks and voluntarily choose to proceed despite them.
4. Indemnification
Your Agreement to Indemnify:
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or related to:
Indemnifiable Actions:
- Your violation of this Waiver of Liability or any other agreement
- Your violation of any law, regulation, or third-party right
- Your misuse of genetic testing services
- Your failure to follow instructions or recommendations
- Your provision of false, inaccurate, or misleading information
- Your failure to obtain proper medical care or consultation
- Medical decisions you make based on test results
- Your sharing of test results with third parties
- Claims by your family members related to your testing
- Your breach of confidentiality obligations
Third-Party Claims:
You agree to indemnify Released Parties against claims by:
- Your healthcare providers
- Your family members
- Your employers or insurers
- Government agencies
- Any other third parties
Defense of Claims:
You agree to:
- Cooperate fully in the defense of any claims
- Provide all necessary information and documentation
- Not settle any claims without Gene Matrix's consent
- Bear all costs of defense and settlement
Survival:
This indemnification obligation survives termination of your use of our services and continues indefinitely.
5. Medical Decisions and Healthcare
Acknowledgment Regarding Medical Decisions:
You acknowledge and agree that:
No Medical Advice:
- Gene Matrix does not provide medical advice, diagnosis, or treatment
- Test results are for informational purposes only
- Results should not be used as the sole basis for medical decisions
- You must consult qualified healthcare professionals
Your Responsibility:
You accept full responsibility for:
- All medical decisions you make
- Seeking appropriate medical care and consultation
- Following up on concerning test results
- Informing your healthcare providers about test results
- Obtaining confirmatory clinical testing when appropriate
- Continuing regular medical care and screenings
Healthcare Provider Decisions:
You acknowledge that:
- Healthcare providers make independent medical decisions
- Gene Matrix is not responsible for healthcare provider actions
- Healthcare providers may disagree with or disregard test results
- You should discuss results thoroughly with your providers
No Guarantee of Outcomes:
You understand that:
- Genetic information does not guarantee health outcomes
- Taking action based on results does not ensure disease prevention
- Not all genetic risks can be mitigated
- Environmental and lifestyle factors also affect health
- Medical science has limitations
Waiver of Claims:
You waive any claims against Gene Matrix arising from:
- Medical decisions you or your healthcare providers make
- Failure to seek appropriate medical care
- Delays in seeking medical attention
- Reliance on test results for medical decisions
- Adverse health outcomes despite genetic testing
6. Privacy and Data Security
Acknowledgment of Privacy Risks:
Despite our comprehensive security measures, you acknowledge that:
No Absolute Security:
- No data transmission or storage system is 100% secure
- Unauthorized access or data breaches are possible
- Genetic data, once disclosed, cannot be completely secured
- Re-identification of de-identified data is theoretically possible
Your Acceptance of Privacy Risks:
You accept the risk that:
- Your genetic information could be accessed by unauthorized parties
- Data breaches could occur despite security measures
- Your genetic information could be used in ways you did not anticipate
- Future uses of genetic data may not be currently foreseeable
- Laws protecting genetic privacy may change
Waiver of Privacy Claims:
Except for gross negligence or willful misconduct, you waive claims against Gene Matrix for:
- Data breaches or unauthorized access
- Disclosure of information as required by law
- Use of de-identified data for research (with your consent)
- Sharing information with service providers
- Any privacy-related damages
Your Privacy Responsibilities:
You are responsible for:
- Keeping your account credentials secure
- Controlling access to your test results
- Deciding whether and how to share results with others
- Understanding privacy implications before testing
- Protecting your own genetic information
Third-Party Privacy:
You acknowledge that:
- Gene Matrix is not responsible for third-party privacy practices
- Sharing results with others is at your own risk
- Family members may be affected by your genetic information
- You should consider family privacy before sharing results
7. Family and Genetic Relatives
Acknowledgment of Family Implications:
You acknowledge that your genetic information may have implications for your biological relatives:
Shared Genetic Information:
- Your genetic results may reveal information about family members
- Family members may have the same genetic variants
- Results may indicate risks for your children or future children
- Relatives may be affected by your decision to test
Family Disclosure:
You acknowledge that:
- You are responsible for deciding whether to share results with family
- Family members have the right to know or not know genetic information
- Sharing results may cause family conflict or distress
- Gene Matrix is not responsible for family disputes
Waiver of Family-Related Claims:
You waive claims against Gene Matrix arising from:

- Family conflicts related to genetic testing
- Decisions by family members based on your results
- Psychological impact on family members
- Family members' decisions to test or not test
Unexpected Discoveries:
You acknowledge the possibility of discovering:
- Non-paternity or misattributed parentage
- Unknown biological relatives
- Adoption or donor conception
- Consanguinity (related parents)
- Other unexpected family information
You accept responsibility for:
- How you handle unexpected discoveries
- Emotional impact of unexpected information
- Decisions about sharing unexpected findings with family
- Seeking appropriate counseling or support
Children and Minors:
If testing a minor, you acknowledge that:
- You have legal authority to consent for the minor
- Results may affect the minor's future
- The minor may have different feelings about testing when older
- You accept responsibility for decisions made on the minor's behalf
8. Discrimination and Legal Protections
Acknowledgment of Discrimination Risks:
Despite legal protections, you acknowledge risks of discrimination based on genetic information:
Legal Protections:
You understand that:
- GINA (Genetic Information Nondiscrimination Act) provides some protections
- GINA prohibits genetic discrimination in health insurance and employment
- GINA does not cover life insurance, disability insurance, or long-term care insurance
- State laws may provide additional protections
- Legal protections may not be absolute or comprehensive
Potential Discrimination:
You acknowledge risk of discrimination in:
- Life insurance applications and premiums
- Disability insurance coverage
- Long-term care insurance
- Mortgage or loan applications (in some jurisdictions)
- Adoption proceedings
- Immigration applications
- Military service
- Social relationships and dating
Waiver of Discrimination Claims:
You waive claims against Gene Matrix for:
- Discrimination by third parties based on your genetic information
- Denial of insurance or employment

- Any economic losses from discrimination

No Legal Advice:
Gene Matrix does not provide legal advice regarding:
- Your rights under GINA or other laws
- Whether to disclose genetic information
- How to respond to discrimination
- Legal remedies available to you
9. Research Participation
Acknowledgment Regarding Research:
If you consent to research participation, you acknowledge:
Voluntary Research Participation:
- Research participation is completely optional
- You can decline research without affecting your testing services
- You can withdraw from research at any time
- Withdrawal does not affect your test results or account
Research Risks:
You acknowledge risks including:
- Your de-identified data may be used in research studies
- Research findings may be published or shared
- Re-identification of de-identified data is theoretically possible
- Research may reveal information about populations or groups
- Future research uses may not be currently foreseeable
No Direct Benefit:
You understand that:
- Research participation may not benefit you directly
- Research is intended to advance scientific knowledge
- Research results may not be shared with you individually
- You will not receive compensation for research participation
Waiver of Research-Related Claims:
You waive claims against Gene Matrix for:
- Use of your de-identified data in research
- Publication of research findings
- Commercial applications of research
- Any indirect benefits to Gene Matrix from research
- Lack of compensation for research participation
Intellectual Property:
You acknowledge that:
- You have no ownership rights in research discoveries
- Gene Matrix may obtain patents or intellectual property from research
- You will not receive royalties or compensation from discoveries
- Research may have commercial applications
10. Severability and Enforceability
Severability:
If any provision of this Waiver of Liability is found to be invalid, illegal, or unenforceable:
- The invalid provision will be modified to the minimum extent necessary to make it valid
- If modification is not possible, the provision will be severed
- The remaining provisions will remain in full force and effect
- The waiver will be interpreted to give maximum effect to the parties' intentions
Jurisdiction-Specific Provisions:
This waiver is intended to be enforceable to the maximum extent permitted by law in your jurisdiction. If certain provisions are not enforceable in your jurisdiction:
- Those provisions will not apply to you
- All other provisions remain enforceable
- The waiver will be interpreted according to your local laws
No Waiver of Rights:
Nothing in this waiver is intended to waive rights that cannot be waived under applicable law, including:
- Rights under consumer protection laws
- Rights to pursue claims for gross negligence or willful misconduct
- Rights under laws prohibiting unfair or deceptive practices
- Statutory rights that cannot be contractually waived
Entire Agreement:
This Waiver of Liability, together with our Terms of Service, Privacy Policy, and Medical Disclaimer, constitutes the entire agreement regarding liability and risk allocation.
Modification:
We may modify this waiver at any time. Continued use of our services after modifications constitutes acceptance of the modified waiver.
Governing Law:
This waiver is governed by the laws of the State of California, without regard to conflict of law principles.

- ✓ I accept full responsibility for my decision to use these services
Electronic Acceptance:
